1. Acceptance of Terms
By accessing or using the E-Delivery platform ("Service"), you agree to be bound by these Terms of Service. If you do not agree to all of these terms, do not use the Service. These terms apply to all users, including delivery companies, senders, drivers, and administrators.
2. Description of Service
E-Delivery is a multi-tenant SaaS platform designed for delivery companies. It provides tools to manage parcels, drivers, branches, senders, payments, and logistics operations. The Service is provided "as is" and may evolve over time with new features or changes.
3. Account Registration
To use the Service, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized access.
4. Subscription & Billing
E-Delivery offers monthly and annual subscription plans. Fees are billed in advance. All payments are non-refundable except where required by law. We reserve the right to change pricing with 30 days' notice. Failure to pay may result in suspension of your account.
5. Acceptable Use
You agree not to misuse the Service. Prohibited activities include: attempting to gain unauthorized access, transmitting harmful or illegal content, reselling the Service without authorization, or using the Service to violate any applicable laws or regulations.
6. Data Ownership
You retain full ownership of your data. E-Delivery does not sell your data to third parties. By using the Service, you grant us a limited license to host, process, and display your data solely to provide the Service to you.
7. Service Availability
We target 99.9% uptime but do not guarantee uninterrupted availability. Scheduled maintenance will be communicated in advance. We are not liable for losses resulting from downtime caused by factors outside our control (force majeure, third-party failures, etc.).
8. Termination
Either party may terminate the agreement at any time. Upon termination, your access will be revoked and your data will be retained for 30 days before deletion, unless you request earlier deletion. You may export your data before termination.
9. Limitation of Liability
To the maximum extent permitted by law, E-Delivery shall not be liable for indirect, incidental, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.
10. Governing Law
These Terms are governed by the laws of Tunisia. Any disputes shall be submitted to the competent courts of Tunis, unless otherwise required by applicable law in your jurisdiction.
11. Changes to Terms
We may update these Terms from time to time. We will notify you via email or in-platform notification at least 14 days before changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
